Terms of Service

Welcome to DMV Ready. These Terms of Service (“Terms”) govern your use of the DMV Ready mobile application (“App”), developed and operated by DMV Ready LLC (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. DMV Disclaimer

DMV Ready is an independent educational and test-preparation tool. DMV Ready is NOT owned, operated, licensed, endorsed, or affiliated with any Department of Motor Vehicles (DMV), state government agency, or any other governmental body that administers, creates, processes, or grades driving license or permit examinations.

The questions, answers, explanations, rules, traffic sign information, and all other educational content in the App are created for study and practice purposes only. They are based on publicly available information from state driver handbooks and traffic laws but may not reflect the exact content, format, or wording of any official DMV examination.

Your state’s official DMV driver handbook and applicable traffic laws are the sole authoritative sources for the material on your actual permit or license exam. Test content, passing scores, question formats, and requirements vary by state and may change at any time without notice to us.

2. No Guarantee of Results

DMV Ready is designed to help you prepare for your permit test, but we do not guarantee that using this App will result in passing any official DMV examination. Your exam results depend on many factors, including your individual preparation, the specific questions on your exam, and your state’s current testing requirements. The App is a supplementary study aid, not a substitute for reading your state’s official driver handbook.

3. Eligibility

The App is intended for individuals who are preparing for a DMV permit or driver’s license test and are of eligible age to apply for such a permit in their state (typically 14 years or older, depending on your state). If you are under 18 years of age, you represent that you have the consent of a parent or legal guardian to use the App. The App is not intended for children under the age of 13.

4. Account and Data

DMV Ready does not require you to create an account or provide any personal information. All study progress and preferences are stored locally on your device. You are responsible for maintaining the security of your device. We are not responsible for any loss of data resulting from device loss, damage, or unauthorized access to your device.

5. Subscriptions and Purchases

5.1 Free and Premium Access

DMV Ready offers both free and premium tiers. Free access includes limited daily usage of certain features. Premium access unlocks unlimited usage of all features and is available through the following purchase options:

  • Monthly Subscription - includes a 7-day free trial, then billed monthly.
  • Lifetime Purchase - a one-time payment for permanent access to all premium features.

5.2 Apple App Store Terms

All purchases are processed through Apple’s App Store. By making a purchase, you also agree to Apple’s Standard End User License Agreement.

5.3 Monthly Subscription Terms

  • Payment will be charged to your Apple ID account at the confirmation of purchase.
  • The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
  • You may manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5.4 Refunds

All purchases are made through Apple and are subject to Apple’s refund policies. We do not process refunds directly. To request a refund, please visit reportaproblem.apple.com or contact Apple Support.

5.5 Price Changes

We reserve the right to change subscription prices. Any price changes for existing subscribers will take effect at the start of the next billing cycle following notice of the change, in accordance with Apple’s policies.

6. Content and Intellectual Property

6.1 Ownership

All content in DMV Ready, including but not limited to practice questions, answers, explanations, rules, traffic sign illustrations, road scenario images, user interface design, graphics, icons, and software code, is the intellectual property of DMV Ready LLC and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial educational purposes. This license does not include the right to:

  • Copy, reproduce, distribute, or publicly display any App content.
  • Modify, create derivative works from, or reverse-engineer the App or its content.
  • Use the App’s content to create competing products or services.
  • Scrape, extract, or systematically download content from the App.
  • Represent the App’s content as official DMV material.

6.3 Traffic Signs

Certain traffic sign designs depicted in the App are based on public-domain designs from the Manual on Uniform Traffic Control Devices (MUTCD) and state driver handbooks. Custom illustrations and artistic renderings of traffic signs, road scenarios, and educational graphics remain our intellectual property.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the App’s code, data, or systems.
  • Interfere with or disrupt the App’s functionality.
  • Use the App in any manner that could damage, disable, or impair the App.
  • Redistribute, republish, or commercially exploit any portion of the App’s content without our express written permission.

8. Content Accuracy

The questions, rules, explanations, and all other educational materials in this App are provided on an “AS IS” and “AS AVAILABLE” basis. While we make reasonable efforts to ensure accuracy and keep content up to date, we make no warranties, express or implied, regarding the accuracy, completeness, reliability, currentness, or suitability of any content for any particular purpose.

Traffic laws and DMV test requirements change periodically. There may be a delay between when a law changes and when our content is updated to reflect that change. Always verify information with your state’s official DMV resources.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DMV READY LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OF OR INABILITY TO USE THE APP;
  • ANY ERRORS, INACCURACIES, OR OMISSIONS IN THE APP’S CONTENT;
  • YOUR FAILURE TO PASS ANY OFFICIAL DMV EXAMINATION;
  • ANY UNAUTHORIZED ACCESS TO YOUR DEVICE OR DATA;
  • ANY OTHER MATTER RELATING TO THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless DMV Ready LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App is immediately revoked. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. We encourage you to review these Terms periodically. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you should stop using the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be resolved in the courts located in Washington State.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App, and supersede any prior agreements or understandings.
